eFlow provides barrier-free electronic toll collection services, including but not limited to:
- Electronic tag-based toll payment processing.
- Automatic Number Plate Recognition (ANPR) toll identification.
- Account management and billing services.
- Related informational and support services through our website.
3. User Accounts
To use certain features of our Services, you may need to create an account. You agree to:
- Provide accurate, current, and complete registration information.
- Maintain and update your information to keep it accurate.
- Maintain the confidentiality of your account credentials.
- Accept responsibility for all activities that occur under your account.
- Notify us immediately of any unauthorized use of your account.
4. Payment and Billing
By using our tolling services, you agree to pay all applicable toll charges incurred by vehicles registered to your account. Key terms include:
- Toll rates are determined based on vehicle classification, distance, and applicable tariff schedules.
- Charges are automatically deducted from your registered payment method.
- You are responsible for maintaining sufficient funds or a valid payment method on your account.
- Disputed charges must be reported within 30 days of the transaction date.
- Late payments may incur additional fees as outlined in our fee schedule.
5. Electronic Tags
If you are issued an electronic tag (RFID transponder):
- The tag remains the property of eFlow.
- You must install and maintain the tag as directed.
- You must not tamper with, modify, or attempt to replicate the tag.
- Lost or damaged tags must be reported immediately.
- Replacement fees may apply for lost or damaged tags.
6. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose.
- Attempt to evade toll charges or interfere with toll collection systems.
- Obscure, alter, or remove vehicle registration plates to avoid identification.
- Access or attempt to access systems, data, or areas not intended for you.
- Transmit any malicious code, viruses, or harmful content.
- Reverse-engineer, decompile, or disassemble any part of our technology.
7. Intellectual Property
All content on this website — including text, graphics, logos, icons, images, software, and design elements — is the property of eFlow or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
8. Limitation of Liability
To the maximum extent permitted by law:
- Our Services are provided "as is" and "as available" without warranties of any kind.
- We do not guarantee uninterrupted, error-free, or secure operation of our Services.
- eFlow shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services.
- Our total liability shall not exceed the amount of tolls paid by you in the preceding 12 months.
9. Indemnification
You agree to indemnify and hold eFlow, its directors, officers, employees, and agents harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Services or violation of these Terms.
10. Termination
We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in fraudulent activity. Upon termination, any outstanding toll charges remain due and payable. You may close your account at any time by contacting us, subject to settlement of all outstanding charges.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
12. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
